KAOA THE FORT OF BENAAMI CARTEL?
Money is the cause of happiness in this materialistic world. To find this happiness people commit illegality. This culminates into a problem when this reaches a level of Billion Dollar. Then it gets controlled by groups called Cartels. It worsens further when this Cartel remains invisible but acts as per the desire of the Devils and Demons in the disguise of the Angels.
One of the largest and safest business arena to make huge money is the business of real estate. This gains more importance not only in developing countries but also the developed countries. The President of USA is a real estate tycoon. Likewise, almost all our Politicians in Karnataka have their pie in this cake called Real Estate. It has given fruits to many politicians to the level of achieving a Ministry portfolio. Incidentally, beyond the party lines when the Cartel leaders become the ministers, also take part in making the laws for apartments. Few of our beloved leaders who claim to be builders, are planning to enact new law for apartments which they build for the common people. It is unlikely, that anyone will make anything against their own interest. Interestingly, the Conflict of Interest doesn’t apply to them because they are elected members.
With so much money, keeping it secret becomes a challenging task. Once again, this industry is misused by some, to hide the black money is what is being heard on the roads. You can pour as much as you have into the skyscraper concrete, it remains safe. But the some leaders try to find ways, but every new solution posed a threat to this illegality starting from the PAN CARD for few days till they design new ways to break it. This card and the Income tax laws instead of catching them started helping these fraudsters to legalize their illegally gotten money by paying tax. This was the reason even the Enforcement Directorate failed to fix illegality of thousands of crores of rupees earned through corruption and blood money. That is why the gangsters wear Coats and Khadi and gain respects in this educated society of ours. Even though the AADHAR CARD and the unique id no has helped reduced the frauds, it failed miserably to control the frauds. Indians are very intelligent because of which they have made beautiful laws which are unimplementable. Common man remains inside this cobweb to find ways to implement these unimplementable laws when the intention is successful to keep the people busy without any concrete results.
Here comes the KAOA protecting the illegal earnings of the respected Cartel members and their supporters through their investment back in this industry. Because this is the industry barring a few found not to comply with any law. And they cannot be asked many questions because they help in forming governments and promotion of people connected with them. Because their partners sitting in the Ministry make the laws to protect them or implement as much as to protect them. Therefore, they are so much courageous to construct apartments in government lands and sell it to gullible owners and then hand it over to the law called KAOA 1972 where everything remains safe and sound without a question of scrutiny. All are happy, but sometimes the happiness turns to greed asking for more. They search for more and more, finding the fatherless and motherless half dried lake, river, backwater beds to construct their apartments. New maps are made by altering old maps to safeguard the interest of this Cartel by the members of the Cartel working in the powerful places in return for a Villa or multiple luxurious apartments which otherwise are unaffordable by any of these middle-class employees. And it is not a big sacrifice to the Cartel to give away freebies to get the legal tag for the illegal structures. To conceal the illegality of the Cartel, they force upon a law to ensure the benaami apartments in the KAOA 1972 associations remain unnoticed, unrecorded because there is not much of a scrutiny in the process. Everything happens on WhatsApp or a software administered by people far away or by those who are members of the Cartel. Sometime the skyscrapers are demolished leaving the buyers at lurch and the violators grow richer and powerful with the support of the Cartel networking.

This is the last invisible Cartel which has not been identified as yet because of the respect the members command from the society in view of their position and power. More important is that the people cannot survive or succeed by talking about them. The disputes are decided in the five-star clubs and bars where the Shakira is heard without anyone noticing them work. But the result is delivered behind the back of the Enforcement Directorate or the CBI. Surprising to note the innocent newcomers to the position innocently fall prey to this game of thorns without being even aware that they are stuck in the Cartel’s cobweb of corruption which cannot be torn by these mortals.

All voices will be silenced through power of position and muscle. All are happy except the home buyers, lakes, environment, and the happiness of the future generation for which we are supposed to be ethical trustees. That is sacrificed in the altar of greed and gutter life.

KAOA 1972 is an ill conceived act that was passed almost half a century back when apartments were almost non-existent in Bengaluru and Karnataka.
The KAOA 1972 Act was formulated basically with a notion that the land owner developer builder would remain as a Jamindar and the apartment buyers would be living on his land as Quasi owner/tenants. The Act never visualised the handing over of the entire apt complex(land,amenities and flats)to the legally formed/properly registered apartment owners organisation.The associations created under this act remain unregistered and hence have no legal standing.They are mere recreation clubs created under the patronage of Builder who will enjoy eternal rights over the apt blocks even after selling them.That Act is a god given gift by the corrupt establishment to the unscrupulous builders.The Act gives free hand for the builders to enjoy the title over the land,raise hundreds of crores of additional funds and put the apt owners at great disadvantage.All these atrocious things happen with the full support of a notorious act,that is KAOA 1972

authorities, govt arms and organisations , which are supposed to protect the interest of Home Buyers, colludes and conspires with these forces to make things easy for the wrong doers. Hope people recognise and support the movement from civil groups against these.

As you rightly pointed out, the root cause for this is the nexus between the politicians and the builder lobby. When the politicians themselves are builders, the unbridled activities reach new heights.

Construction of Apartments starts with corruption by cartels who built it and fooled the gullible buyers. What repeats is while managing the complex by so called “members” with vested interests as real estate agents – both in renting out and subsequent sales. Added to this one mini cartel running a temple in the complex as a micro corruption center. People managing complex are not answerable to any authority and if questioned member is isolated ( from What’s up group ) and ostracised as trouble maker. All fudged records of general body decisions,fudged accounts, forged and inflated vouchers reducing members in to submission for they are busy with earning a living. Others who are senior citizens, widows and those waiting for death are mute spectators. It is a complex situation and Courts will be choking with litigations involving Apartments in days to come. Aprtment dwellers will become modern day slaves with Courts favouring interests of larger population as if the people managing are paragons of virtue and making a hoax of democracy.
